When you book with
Sardinian Spirit we commit to providing the best personal service and we ensure
we will to our utmost to provide a fantastic holiday. From the time of the first
co-operation on the website, or by direct contact, to the dispatch of your tickets,
invoice etc. to you, a contract exists between us. This means that Sardinian
Spirit has certain responsibilities towards you, our client, and you have certain
responsibilities towards Sardinian Spirit.
This agreement also governs your use
of our Website and our Printed Materials, please read it carefully. By using,
viewing, transmitting, storing or otherwise utilizing the Site and Printed Materials,
the services or functions offered in or by the Site or Printed Materials and/or
the contents of the Site and Printed Materials in any way, you have agreed to
each and all of the terms and conditions set down in this contract
Your contract with us
Your Booking
By Telephone, email or printed materials - The receipt of the deposit (or the full amount if within eight weeks of departure) by Sardinian Spirit and the completed booking form received by you the customer (including the names of all members of the party) signifies a confirmed reservation. The party leader is responsible for keeping everyone in the party informed of the booking details. Once the reservation is confirmed we will send you a holiday invoice/confirmation showing the confirmed details. When you receive this, please check for any errors and if any detail on it is not correct us immediately in writing or via e-mail.
Payment
By Telephone, email or printed materials - You must pay the amount on
the invoice at least six weeks before you go on holiday, unless otherwise stipulated.
No reminder will be sent. If you don't settle the balance, we can treat your
booking as cancelled by you and charge you cancellation charges. There is a charge
for each transaction made by Credit Card.
If you request Sardinian Spirit to confirm
flights for you in your behalf, full payment of these will be required after
confirmation is sent. Due to the nature of flight confirmations over the internet,
no refunds will be offered in light of cancellation, however we will do our best
to make any requested amendments at the lowest possible charges, but please be
aware that we will be restricted in most cases by the charges that are set by
the airlines.
If you want to change your holiday
If, after we have accepted your booking, you want to change any details in any
way (for example your chosen departure date or accommodation etc) please write
or email us and we will do our best to help although we cannot guarantee that
we will be able to do this. An amendment fee of £15 per person detailed
on the booking invoice will be charged for each detail of the booking you wish
to change, and any charge levied by our suppliers will be passed on to you. The
price of your new holiday arrangements will be based on the prices that apply
on the day you ask for the change.
If you wish to cancel
If, after we have received your booking and all amounts are paid in full, you
or a member of your party wish to cancel any part of their holiday booking through
us, you must let us know in writing or email. To cover the administrative costs
involved and the risk of not being able to resell any part of the holiday, we
charge a cancellation fee on the scale shown below. You should be aware that
these costs could increase the closer to the departure date that changes are
made - the more notice you give, the less we will charge. Cancellations are considered
to come into effect from the day they are received in writing or email to our
office. If any member of your party is prevented from travelling, that person
may transfer their place to someone else providing that we are notified at least
2 weeks before departure. Amendment charges will be levied.

The Agreement
Sardinian Spirit and you are deemed to accept, in full, the Booking Conditions
laid out in the agreement. They set out the terms governing your booking and
also explain the arrangements Sardinian Spirit has made to protect your interests.
You may be able to make a claim on your travel insurance in certain circumstances,
please refer to your insurance policy for the terms and conditions.
If you have a problem or complaint
If you have a problem either before or while you are on holiday you must report
it to us immediately and we will make every effort to remedy the matter as soon
as possible.
Behaviour/Holiday Participation
We reserve the right to refuse to accept you or to continue to deal with you
as a client if your conduct or that of any member of your party is likely, in
our reasonable opinion or that of any other person in authority, to disrupt or
affect the enjoyment of other holiday makers, or to cause distress, damage, danger
or annoyance to other clients, employees, anyone else or their property. We will
not be liable for any subsequent costs incurred by you for completing your travel.
Responsibility & Age
You represent and warrant that you are at least 18 years of age and possess the
legal right and ability to enter into this Agreement and to use this Site or
Printed Materials in accordance with the terms and conditions. You agree:
To be
financially responsible for all use of this Site and Printed Materials (as well
as for use of your account by others, including without limitation minors living
with you).
Not to assign, transfer or sublicense your rights pursuant to this Agreement.
To supervise all usage by minors of this Web Site and our Printed Materials under
your name or account; and that you shall be completely responsible for all charges,
fees, duties, taxes and assessments arising out of the use of this Site and Printed
Materials.
Proprietary Rights
Information contained on the Sardinian Spirit’s Websites and Printed Materials
concerning any products and services (including but not limited to Sardinian
Spirit’s products) may only be applicable in certain areas. You acknowledge
and agree that all materials contained in the Site and Printed Materials and
provided to you during your use of the Site "Content" or Printed Materials
are the property of Sardinian Spirit. You may retrieve and display Content from
the Site or Printed Materials, on a computer screen, print individual pages on
paper (but not to photocopy them) and store such pages in electronic form on
disk (but not on any server or other storage device connected to a network) solely
for your personal, non-commercial use. You agree not to copy, modify, distribute,
sell or create derivative works based on any of the Content.
Indemnity
As a condition of use of this Site and Printed Materials, you agree to indemnify
Sardinian Spirit and its employees, agents, suppliers and other partners from
and against any and all liabilities, expenses (including lawyers fees) and damages
arising out of claims resulting from (I) your use of the Site and Printed Materials;
and (ii) any material you post to or transmit through the Site including claims
for Intellectual Property right infringement or defamation.
Sardinian Spirit is acting solely as agent for the customer and does not have any liability for any failure by the hotel/villa to provide any element of the customer’s booking and/or for anything which may go wrong at the hotel and which causes damage, loss, personal injury or death to the customer whether as a result of negligence or otherwise by the hotel/villa, its servants or agents and Sardinian Spirit only has liability to the customer for claims which arise solely as a result of Sardinian Spirit’s own negligence.
Every care is taken to ensure that hotel/villa descriptions are accurate. Descriptive material on facilities provided at the hotel/villa is drawn from information provided by the hotel/villa. Sardinian Spirit can not be held responsible for any inaccuracies in such information, nor can liability be accepted for changes to facilities, which are not communicated to us by the hotel/villa.
Our contract with you
You can book the holidays, tour, hotels etc and take up the offers advertised
on our website (and printed materials) provided they are still available. We
will arrange the provision to you of those services that form part or all of
your booking as detailed in our Confirmation/Invoice. These services will be
provided either directly by ourselves or by independently contracted suppliers.
Our
Guarantee on Price
All prices are quoted in pounds sterling and/or Euros and apply at the time of
editing and printing but we reserve the right to change prices from time to time.
Prices can go up or down but whatever happens to the value of the Pound, the
price of your holiday, tour, car hire etc will not be subject to any currency
surcharges. After your booking has been processed your holiday may be subject
to surcharges on the following items: aircraft fuel and scheduled fares.
If we
Change your Holiday Schedule
Whilst we always try to avoid changes, we must reserve the right to do so. Occasionally
we have to make adjustments to errors printed in our literature and website both
before and after bookings have been confirmed. Accommodation changes also occur
though rarely, e.g. hotel services may be withdrawn or limited and we will notify
you as soon as we know if there is time before your departure.

We regret we cannot pay any expenses, costs,
or losses incurred by you as a result of any change. The above provision is not
available for changes which are not major or where a major change is made more
than 8 weeks before departure. Very occasionally we have to change your holiday
arrangements after you arrive in the resort. If we do this, we will try to place
you in accommodation of the same or higher standard in the same or similar resort.
We will pay you compensation according to the scale shown above. You have no
right to cancel your booking after you have left for your holiday if we offer
you a suitable alternative.
If we cancel your Holiday
We must reserve the right to cancel your holiday, tour, car hire etc in any circumstances.
If we have to cancel your holiday arrangements we will tell you as soon as possible
(normally at least 8 weeks before departure) in which case you will receive a
full refund of all monies you have paid to us. Additionally we will pay you compensation
according to the table shown above. No compensation will be paid if the cancellation
is because of minimum numbers not being reached or due to force majeure. No compensation
will be paid if your booking is cancelled as a result of your failure to make
all payments in full on time. We regret that we cannot pay any expenses, costs
or losses incurred by you as a result of any cancellation.
Our Liability to You
We accept responsibility for ensuring that your travel arrangements which you
book with us, are supplied as described in our printed materials and website.
If any parts of your travel arrangements are not provided as promised, we will
pay you appropriate compensation if this has affected the enjoyment of your holiday.
We are not responsible for the acts and omissions of our suppliers and subcontractors
and our only responsibility is to make a responsible choice of such persons.
We do not accept responsibility for death, injury or illness caused by the negligent
acts/and or omissions of our suppliers and subcontractors.
Where any claim or
part of a claim concerns or is based on any travel arrangements (including the
process of getting on and off the transport concerned) provided by any air, sea,
rail or road carrier or any stay in a hotel, the maximum we will have to pay
you in respect of that claim or that part of a claim, if we are found liable
to you on any basis, is the maximum which would be payable by the carrier or
the hotel keeper concerned under the applicable international convention. You
must give credit for all payments due or received from any carrier or hotelkeeper,
which in any way relate to the claim in question.
Events not connected with your Holiday Package
Should you or any member of your party suffer illness, personal injury or death
through any misadventure arising out of an activity, which does not form part
of your holiday arrangements, nor part of any excursion sold through us, we shall
offer you reasonable assistance. However, in this unlikely event of any such
misadventure, you should contact your insurance company immediately.
Force Majeure
This means that we will not pay you compensation if we have to cancel or change
your travel arrangements because of war or threat of war, government action,
riots, civil strife, industrial dispute, terrorist or scientific disaster, fire,
epidemics and health risks, technical problems with transport, changes in the
times of scheduled airlines, closed or congested airports or ports, actual or
potential adverse weather conditions and any unforeseen circumstances that are
beyond our control.
Advertising
Part of our Site and Printed Materials may contain advertising. Advertisers are
responsible for ensuring that material submitted for inclusion on the Site complies
with the relevant law. Sardinian Spirit does not endorse these products or services
advertised and are not liable or responsible for any error or inaccuracy in advertising
and standard of its service.
Website use
Sardinian Spirit makes no warranty that their sites are free from viruses and
therefore are not liable for any claims against them. The user must ensure that
they have the appropriate firewalls, anti virus and anti spy ware software etc.
